Terms of Service

These Terms of Service (“Terms”) govern your access to and use of RecruitGPT. They explain what you can expect from us, what we expect from you, and the limits of our responsibility. Please read them carefully — by using RecruitGPT you agree to them.

1. Acceptance

By creating an account, clicking to accept, or otherwise using the RecruitGPT website, applications and services (together, the “Service”), you agree to these Terms and to our Privacy Policy. Candidates also agree to the Candidate Consent notice, and employers also agree to the Employer Terms, which form part of these Terms. If there is a conflict, the Employer Terms prevail for employer accounts on matters they specifically address.

If you use the Service on behalf of a company or other organisation, you confirm that you are authorised to bind that organisation, and “you” includes that organisation. If you do not agree to these Terms, do not use the Service.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract under Indian law to use the Service. You must not use the Service if you have previously been suspended or removed from it, unless we have expressly allowed you to return.

3. Accounts & security

  • Provide accurate, current and complete information and keep it updated.
  • Each account is for one individual. Do not share your credentials or let others use your account. Employer workspaces add colleagues as separate seats.
  • You are responsible for activity under your account. Keep your password confidential and tell us promptly at support@recruitgpt.in if you suspect unauthorised access.
  • Employers must register with a genuine work email address for the organisation they represent.

4. Candidate & employer roles

Candidates use RecruitGPT to build a Talent Passport — a structured, evidence-backed record of their skills, experience, projects and certifications — to control who can see it, to apply for jobs, to communicate with employers, and to request verification of their claims.

Employers use RecruitGPT to create jobs, search for and review candidates whose visibility settings allow it, see evidence against each job requirement, message candidates in-app, manage a hiring pipeline, and, on eligible plans, request verification and send assessments.

RecruitGPT is a platform. We are not an employer, recruitment agency or party to any employment relationship between candidates and employers. We do not guarantee that candidates will find jobs or that employers will find suitable hires, and we are not responsible for the conduct, offers or decisions of any user.

5. Acceptable use

You agree not to:

  • scrape, crawl or bulk-export data from the Service by automated or manual means, or circumvent rate limits or access controls;
  • create fake profiles or fake jobs, impersonate any person or organisation, or misrepresent your qualifications, employment history or evidence;
  • upload forged, altered or someone else’s documents as your own evidence;
  • harass, threaten, spam or abuse other users, or send unsolicited commercial messages;
  • discriminate against any person on the basis of age, gender, religion, caste, marital status, disability or any other characteristic protected by law, or try to infer such attributes;
  • charge candidates any fee for job opportunities, or use the Service to promote schemes that require payment from candidates;
  • upload malware, attempt to probe, scan or breach the Service, or interfere with its operation;
  • use the Service in violation of any applicable law, including data protection and employment laws;
  • reverse engineer the Service or use it to build a competing product or database.

You can report fake profiles, fake jobs, abuse or privacy concerns from within the product or by emailing support@recruitgpt.in.

6. Your content & licence

“User Content” means anything you submit to the Service, including profile data, resumes, evidence documents, job descriptions and messages.

  • Candidates retain ownership of their Talent Passport and all User Content they provide. Employers retain ownership of their job descriptions and workspace content.
  • You grant RecruitGPT a limited, non-exclusive, royalty-free, revocable licence to host, store, process, reproduce and display your User Content solely to operate and provide the Service to you — for candidates, only in accordance with your visibility and sharing settings.
  • This licence ends when you delete the content or your account, except for copies we must keep by law, in backups for a limited period, or content already shared with an employer through an application you made.
  • You confirm that you have the right to submit your User Content and that it is accurate and does not infringe any third party’s rights or confidentiality obligations (for example, do not upload an employer’s confidential project documents without permission).

We may remove User Content that we reasonably believe violates these Terms or the law.

7. AI features

The Service includes AI-assisted features such as resume extraction, job description structuring, evidence summaries per requirement, assessment summaries and interview preparation. These features are assistive only.

  • AI output may be incomplete, outdated or wrong. Always review it before relying on it.
  • Candidates must review and confirm AI-extracted information before it is treated as confirmed; until then it remains labelled “AI Extracted”.
  • Recruiters and employers make all hiring decisions. AI does not reject, shortlist, rank by an opaque score, or recommend hiring anyone.
  • You must not use AI outputs from the Service as the sole basis for any decision with legal or similarly significant effects on a person.

8. Verification

Candidates may request verification of items in their Talent Passport, and employers on eligible plans may request verification of candidates they are considering. Verification is performed by human review of the documents and evidence submitted, and the outcome (for example Verified or Unable to Verify) is recorded with the method used.

  • Verification is not a background check, criminal record check, credit check or reference check performed by a licensed agency, and must not be treated as one.
  • No third-party verification provider is currently connected. A “Verified” label means a human reviewer was satisfied with the evidence submitted at the time of review — it is not a guarantee of authenticity, accuracy or future validity.
  • Candidates may dispute a verification outcome, and we will review the dispute.

10. Our intellectual property

The Service, including its software, design, text, graphics, logos and the RecruitGPT name, is owned by us or our licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service for its intended purpose. You may not copy, modify, distribute or create derivative works of the Service except as allowed by law. If you send us feedback, we may use it without obligation to you.

11. Suspension & termination

  • You may stop using the Service and delete your account at any time from your settings.
  • We may suspend or terminate your access, remove content or restrict features if you breach these Terms, if we reasonably suspect fraud, fake profiles or jobs, abuse or misuse of candidate data, if required by law, or to protect users or the Service.
  • Where appropriate and lawful, we will tell you the reason and give you an opportunity to respond. You can contest a suspension by writing to support@recruitgpt.in.
  • On termination, your right to use the Service ends. Sections that by their nature should survive (including content licences for legally retained data, disclaimers, limitation of liability, indemnity and governing law) survive termination.

12. Disclaimers

To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis. We do not warrant that the Service will be uninterrupted, error-free or secure, that AI outputs will be accurate, or that any profile, job, evidence or verification outcome is complete, true or current. We do not vet every user or every piece of content. You are responsible for your own decisions, including hiring, job acceptance and any due diligence you consider appropriate.

13. Limitation of liability

To the maximum extent permitted by applicable law:

  • RecruitGPT will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data, goodwill or opportunities, arising from or related to the Service;
  • we are not liable for the acts, omissions, offers, hiring decisions or content of candidates or employers;
  • our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amounts you paid to us for the Service in the 12 months before the event giving rise to the claim, or (b) ₹10,000.

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud or for obligations under the DPDP Act that cannot be contractually excluded.

14. Indemnity

You agree to indemnify and hold harmless RecruitGPT and its officers, employees and service providers from any claims, losses, liabilities and expenses (including reasonable legal fees) arising from your User Content, your misuse of the Service, your breach of these Terms, or your violation of any law or the rights of a third party — including, for employers, any misuse of candidate data or unlawful hiring practice.

15. Governing law & disputes

These Terms are governed by the laws of India. Subject to any mandatory rights you may have as a consumer, the courts at Bengaluru, Karnataka have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service. Before starting formal proceedings, please contact us so we can try to resolve the issue informally within 30 days.

16. Changes to these terms

We may update these Terms from time to time. The version and date appear at the top of this page. For material changes we will give you reasonable notice in the app or by email. Continuing to use the Service after changes take effect means you accept the updated Terms; if you do not agree, you should stop using the Service and may delete your account.

If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets.
